Some terms barred from being in Texas child support orders

The process of reaching a child support arrangement in a divorce of parents here in Texas can have many complex aspects. One reason for this is that the state has quite a few laws in place that regard child support.

Child support arrangements here in Texas can contain a wide variety of terms. However, there are certain terms that state law prohibits from being included in such arrangements. One such prohibition regards visitation and full noncustodial parents.

Visitation rights are something such a noncustodial parent may treasure deeply and, thus, making sure such rights are properly respected is something that a such noncustodial parent might hold to be a very high priority. This may lead a full noncustodial parent to wonder if the child support arrangement regarding their child could be set up to help protect these rights through making child support payments conditional on their visitation rights being respected.  

Texas law prohibits child support arrangements from being used in this way. Specifically, state law generally bars court orders regarding child support from containing terms that would make child support payments conditional on visitation being allowed by the custodial parent. Thus, full noncustodial parents have to look to other methods for protecting their visitation rights.
